As some of you may remember I HAD a BMS (type) 260. It had a million problems and I finally got fed up and bought a real bike (Hayabusa). Then I came up with the idea to rent the scooter out at the DMV but before I could get all that going someone stole it. Sometime last October John Law actually found it on the side of the road and had it towed. Here's where the problem starts, at the same time this was happening I had some personal issues and I forgot all about the scooter.  So few months later the fly by night towing company sends me a letter demanding $1000 dollars or they will sell the scooter. I said (to myself) good luck with that! I figured the matter was closed until I received another letter from a collection agency on behalf of the towing company for even more $$$$. I was pissed to say the least, I mean I was the victim here. I also started thinking that nobody wanted to pay more than $5 bucks for the scooter which is why they were trying to turn the screws on me. So I'm wondering what I can do about this. I thought I might call the towing company and explain what happened and if they still have the scooter then I would pay the towing bill only, not all those other made up fees. Any suggestions? I still don't know what condition the scooter is in. |

I would just let them keep in myself. If you have no interests, then don't bother. Great country we live in...Your scoot gets stolen & you get a $1,000 bill. Those towing companies are sharks!

You should go talk to them in person and see if they will be reasonable. Maybe they'll take $200 or so? They don't want to see it go to court and still never get paid.

Did you file a police report at the time of the theft? (I don't see how they can hold you responsible.) That is the bike that just keeps on "giving" ain't it?

They are most likely charging you for storage. That happened to me once when an old car caught fire, the fire dept came by, ripped the car to bits (they really were enjoying themselves) and towed it away. When I went to go clean my stuff out at the tow yard I asked about parts or scrap value and they explained that they have the right to charge me a per day storage rate, and are planning on it. We ended up just letting them keep the car and walking away from it without a bill.

If it was me I would want to know where I stood as far as your responsibility lies for this 1000 dollars. Talk to a lawyer. If nothing I would just forget about it and leave it at the tow company but find out first. Maybe you will have to take it to small claims court?

I had a truck stolen once, this was about 1976. Filed a police report they came down talked to me and left, turns out the next day they found it in a apartment building garage, it had been stripped, it was towed to a storage place and I was not told about it until about six months later. The police never ran the vin on it to see who the owner was but the storage people were filing a mechanics lien against to get some money. They contacted me for the bill, I went down there and saw the hull of a truck and told them they could keep it. I never heard about it again. Too bad because if the police had simply run the vin and told me they found it I would probably have put it back together. The bill and repair were going to be a lot more than the cost of just buying another one.

I would have cashed the insurance check on that one a long time ago. The bike and any fees associated with its recovery now belong to the insurance company that wrote the policy on the bike.

You're seemingly not the first with problems on the BMS260. Me too. Seems these bikes are less reliable than some of the cheaper scoots.
I have less problems with my tao (so far) than with the BMS.

If it went to collections then it may effect you're credit rating, if you can call them (the tow company) and tell them it was stolen, if you have the police report number give it to them and make them follow up on it and correct the collections

I reported it stolen and contacted my insurance immediately unfortunately I didn't have theft coverage. In my stupidity I thought it basic insurance covered that. What really worries me is the fact that I don't know what condition it is in. If it's trashed then I'd have to pay to register it so I could park it at my apartment complex. Not to mention pay to get rid of it cause I'm not gonna rebuild it, I had just spent $200 to get it working again. I didn't contest the lien sale so i don't understand why they are bothering me unless no one bought it.

Well full coverage on a scoot covers everything what did you have just libility.

The plastics were only have there and it really didn't look like it would even start. Plus it had a shiny new neon green disc lock so I didn't give it a second thought. I'm still debating on going with full coverage on the Hayabusa though. I use a disc lock and a big old security chain on that bugger. |

If it went to collections then it may effect you're credit rating, if you can call them (the tow company) and tell them it was stolen, if you have the police report number give it to them and make them follow up on it and correct the collections H3nry: They cannot effect this "credit rating" as they don't have his Social Security # This isn't cc or a loan my friend. He is in the clear if he decides not to pick-it up. |

Myself, I would not ignor the letters. At this point, I thin I would at least make a phone call. Be prepared and have copies of any paperwork handy and alsp be prepared to,be nice.
being an A hole newver helps. It is rare the blowed ther hers off helps either although I often would like to. Sometim, I end up making a friend. Never wrong to try/

So your saying I should just leave it alone then??? Yes...You are not liable for the stolen scooter. The junk yard doesn't not have your SS#, nor did you sign any agreement with them. You could give them a call....but if you're planning on not keeping the scooter, then your best bet is to do nothing. The letters will stop coming in time. |
