Midwest Scooters has failed to pay the judgment against them, and (See Midwest Scooters of Indianapolis Update) here is the latest letter I sent to them.
But I have questions to the business owners who read this forum to help me better understand: Why would a company who states on their web site they have been in business for ten years and claim to be one of the largest importers of scooters fail to pay a court order, and risk having those events leading up to that court order placed on a forum like this where other potential customers could read. (JUST CURIOUS)
Dear Steve Schafer, (Registered Agent)
The purpose of this letter is a demand of payment for the judgment rendered in my favor by the Marion County Small Claims Court, presiding Judge Robert S Spear.
Case Number: 49K04-1209-SC-005263
On October 2, 2012 the Marion County Small Claims Court has ordered the defendant (Midwest Scooters) to pay the sum of
$1284.00 to the plaintiff (****** *****) for a total
judgment of $1284.00 plus court costs and post judgment interest at 8% per annum.
However, being a reasonable individual I am willing to offer you a settlement so the judgment against Midwest Scooters may be
satisfied, and the lien against your business may be removed,
but I must hear from you within five (5) days of this letter for this one time offer to remain valid.
Unless an agreement can be made or a payment made in full of the above amount within five (5) days of the date of this letter
I will assume that you wish to continue to ignore a court order
and I will have no alternative but to exercise whatever rights and remedies I have under the law to enforce such payment,
including but not limited to institution of legal proceedings
against you to recover the above amount, together with accrued interest and legal expenses.
