hey guys, been lurking here for a few months, and learning how to fix some problems on some scooters my friends have. this is the best site i've found for fixing some of the problems i've run into. most recently was an electrical gremlin i determined to be a faulty stator or flywheel. here's a little back story for this sort of long post. the electrical gremlin was determined because all other sourced had been exhausted. new battery, voltage regulator, cdi, wiring harness, headlight and kill switch. basically everything but the stator. funds are tight so i decided to order a stator/flywheel combo from mxmotorsports.com. they were the cheapest by $10 not including shipping, and it's shipped from fl. a 2 day trip with any carrier. i ordered the part on saturday (8/11) knowing it wouldn't ship until monday (8/13) at the earliest. money for the parts cleared 8/13. kept checking my mail for a "shipped" confirmation email. nothing on monday, tuesday, or wednesday. i emailed them yesterday to ask if and when the parts had shipped....the following are my emails to mxmotorsports, and the responses from rick@mx

I was wondering if, or when, order #XXXX would be shipping? From the information on the website, it says processing takes between 24-48 hrs before shipping. The order was placed on saturday, and if you're open on Saturdays and Sundays, it should have shipped Monday or Tuesday at the latest. Payment for the parts cleared my bank on Monday. I have a customer expecting these parts in hopes of getting their scooter back by the weekend. Any information you could provide regarding this matter would be greatly appreciated.
Thank you for your time,

hi rick,
is it being shipped tomorrow? delivered tomorrow? your email was a little vague. if it's being imported from china you should let your customers know you are a drop ship company, not telling us you need 24-48 hrs to process while you get it ordered from somewhere else. if the part was in a "warehouse" ready to ship like your "about us" link states, it wouldn't take 5 days to leave the building. so, essentially it's going to take a week to get a part from FL, CA or TX to south carolina? i could have ridden a moped to miami and back in the time it's going to take this part to get here. i've been in the shipping business for 15 years, and when parts don't ship the same day or the next (for ANY reason), the customer is informed of the delay so they can either make other arrangements or wait. i work on mopeds as a side job for friends and most of these people have no alternate forms of transportation, so while their moped sits here we're all losing money waiting for things to ship, including you. mainly because while parts may be more expensive elsewhere, the lag time in the customer receiving parts will hurt a cheaper parts business when customers decided to pay more for the same parts and get quicker delivery. if your parts aren't in stock but still obtainable with extra shipping time, it should be stated somewhere so as a customer we can make an informed decision instead of thinking it'll be in the mail the next business day. most people don't consider parts to be "in stock" in an u.s. warehouse, when the stock is really overseas. thank you for your time, but next time i'll probably do business elsewhere.
sincerely,

rick,
it's not that bad? maybe on your end it may not seem like it. you've already been paid for being a middle man. you aren't losing anything presently, but word of mouth does spread quickly on internet forums, and i post regularly to 5 of them. my problem is the lack of, or outright lying about, when parts are, or will be shipped and what is stocked. losing money waiting for something that should have shipped 4 days ago doesn't make anyone on this end happy, especially MY customers. they are paying $40 each way to work for taxi service. $80 a day x 5 (now 7) = $400-$560 compared to the $240-$280 they SHOULD have paid had the parts shipped when your site said they would. telling your customer it'll be next week instead of this week, more than doubling what they intended to spend getting to and from work, plus the cost of parts and labor makes ME look bad, when i they realize they could have gone somewhere else. AND they most likely will next time. for the prices this person is shelling out waiting for it, they could have bought a NEW MOPED! neither of which would benefit me or YOU, because they'd buy locally as most do.
i have the same access to the same parts on a host of different websites, including ones from china. there is no reason it should take more than a week for a package to move from florida to south carolina if the part was IN STOCK in florida to begin with, like u.s. customers are led to believe. it's the only reason the purchase was made (aside from price). i would have been better served ordering directly from china or a higher priced u.s. dealer with parts on hand like i have in the past, but as your site says..."We do not ship on Saturdays, Sundays, or Holidays. Any orders placed on Saturday or Sunday will be processed the next business day." that, to me and most people, states it should have processed monday or wednesday at the latest, and be shipped that day to be here by friday, in most cases, from florida. your site also states,
"Most Orders are ready to be processed for shipping within 24 to 72 business hours (3 business days)."
Shipping transit schedules range from 1-7 business days depending on the delivery location. Please see our transit map for more details."
Shipping Orders:
Items that are available for immediate delivery will "Usually ship within 24 to 72 hours". These items are usually shipped the next business day after your order is placed if we receive the order by 11:00am Pacific Standard Time, also are subject to a successful payment delivery. If the order is received after 1:00pm Pacific Standard Time, your order will usually be shipped within 48 hrs. Remember that Saturday and Sunday are not considered business days and no packages will be shipped on these days. There may be an occasion when we are temporarily out of stock on a particular item. Items that are not available for immediate delivery will state they are "temporarily out of stock". We may be expecting a normal shipment from the manufacturer or the item may be on back-order from the manufacturer. Usually we are restocked in a matter of days but on occasion an item can take weeks to be restocked. You can always contact us to find the current status of a certain item you wish to purchase. Please note that due to the high demand for scooters they are taking longer to send out orders some products have a waiting list and you will see the information on each products that is order! it will be listed how much time it will take to be sent!"
again, wednesday at the latest, is when it should have shipped, not friday. friday would be 5 days of "processing."
shipping from anywhere in FL to SC is 2 days maximum with ANY carrier in the u.s.. it shouldn't take 7+ days to leave the warehouse for ANY reason other than parts not being on hand as they were stated to be. when the items were ordered, there was no mention of parts being "temporarily out of stock," or unavailable for shipping. i'm fine with drop shippers, and middlemen as it were, but MOST places would have it shipped directly to the customer, via the manufacturer just by changing the "ship from" box, saving time and money for you as well as the customer. it's simple, you sit there, make money, and never touch anything, and cut down on 2-3 days of "processing and shipping" time. like i said before i've been doing this (shipping internationally) for 15 years, and even if ordering direct from china, i would still have the product this week. mainly because i wouldn't have it routed to florida first, only to be relabeled, and shipped back out, adding 3 extra days. the solution is simple, have your distributor change the ship from box on their shipping software and this never becomes an issue. everyone wins.
MY problem is that your site states you have warehouses in the u.s. with parts available for shipment in 1-3 days. add in the 2-3 days shipping to my location it should have been a 5 day process total, not 5 days plus shipping even from california. like i said, it may not seem bad on your end, but when i take the $1000+ a month i spend on parts to other websites and try to steer folks away from yours, i'm assuming it really won't be that bad for you either until people realize they'd be better served paying the $10 more to have something a week sooner than with your company. stating that you have something you don't and then calling it "processing" while you wait for it's delivery, only to send back out is not a good way to do business. to me it's blatantly false advertising, you don't have what you say you do. i don't tell my customers i have the parts when i don't. i could have ordered the same parts on ebay and have them on the moped right now. i could have ordered them from china last saturday and have had them here tomorrow. instead i opted for something cheaper because it should have arrived by friday, and still kept me in good standing with a new customer. that, however, isn't the case any more. here's something that i found that explains this better than i could....
"TARP, a behavior research company based in Arlington, Va., found something interesting while exploring the effects on businesses of word-of-mouth. The study found that customers who leave a business happy and satisfied with their experience may share the positive occasion with just a few friends who will not remember much of the conversation, and not think to share the information. On the other hand, TARP found that customers who had an awful experience will share their negative incident with an average of 12 other people. In turn, each of those 12 people will mention the occurrence to six others. This means that the one person with the bad experience will discuss it with 12 others, and each additionally to six individuals. Do the math: (1+12+ (12x6)) which totals to 85 people who will have a tarnished view of your business because of one negative experience.
Furthermore, a 2005 study by Informative Inc. confirms TARP’s findings, and also includes some fascinating financial information. Informative Inc. found that negative word-of-mouth has an average of 2.4 percent more financial impact than positive comments. As negative comments increased, profits decreased. Following the same pattern, as negative comments decreased, profits increased. Surprisingly, there was little correlation between positive word-of-mouth and profits."
i'm losing money and my customer is losing even more money every day at this point, plain and simple. in some way my business will suffer from it weather i know it or not, and yours will too. if you're primarily a drop shipper, state that you are on your website so people can make an informed decision. don't say you have parts ready to ship when they aren't, your "processing and shipping" claims are illegal. just so you know....
"Any advertising or promotion that misrepresents the nature, characteristics, qualities or geographic origin of goods, services or commercial activities" (Lanham Act, 15 U.S.C.A. § 1125(a)).
Proof Requirement
To establish that an advertisement is false, a plaintiff must prove five things: (1) a false statement of fact has been made about the advertiser's own or another person's goods, services, or commercial activity; (2) the statement either deceives or has the potential to deceive a substantial portion of its targeted audience; (3) the deception is also likely to affect the purchasing decisions of its audience; (4) the advertising involves goods or services in interstate commerce; and (5) the deception has either resulted in or is likely to result in injury to the plaintiff. The most heavily weighed factor is the advertisement's potential to injure a customer. The injury is usually attributed to money the consumer lost through a purchase that would not have been made had the advertisement not been misleading. False statements can be defined in two ways: those that are false on their face and those that are implicitly false.

all 5 requirements have been met in this case.
i'd love to hear your definition of "bad," it could change dramatically some day.

just a heads up for the guys who buy parts......don't buy here if you expect to get it within a reasonable amount of time. i would ask for my money back but from what i've read on the net lately, it won't happen. i'm hoping the stator does ship tomorrow, but it still won't be until next week before it gets here. that's 10 days without wheels, when it could've been bought on ebay for the same price and installed today. lesson learned and hopefully passed on to others. don't buy from here unless you have nothing but time to kill waiting for it. i know i don't, nor do my friends. plenty of other sites who do treat customers right....just my $0.02 on the experience with this company, ymmv, but i doubt it.
