In MS, it was unlawful for passenger to be under 16 yo. Not going to say more but you're the one who has to live with it if anything bad happens to the wee one.

yeah, I have a 4 year old who really really wants to go for rides with me. We told her she cant ride until she can reach the foot rests and has a helmet (only the helmet is required in ID for those under 18). It's tough for me too cause I want to take her! Another year or two...

As far as whether it's legal here in VA, it would be if he had an approved helmet. But I'll be the first to say that it's not the smartest thing to do. It's not like I took him for a ride around town though. We just went a block or so down our quiet residential street and back. He enjoyed the heck out of it.

If it were my child, I'd want him decked out head to foot in protective gear. My grandkids all beg for rides, but no one gets one until they are 16, and then only on the Mod Quad, (Honda Silverwing with a Tow Pac trike kit).
