Make sure you know which you have, just had a friend get into a serious accident and lost his license because the police said it was a 50cc and not a 49cc which is legal to not have registered or insured etc. Since they said it was 50cc they gave him failure to register, no insurance, no M endorsement, and failure to maintain financial responsibility. And of course pay for the car and his own hospital bills. If in doubt check the base of the cylinder at the engine. If it says 49 cm3 you are good. If it says 50cm3 you may have your scooter taken from you and left with a large amount of tickets, especially if youre involved in an accident. Also if in doubt get it registered and insured if you can. If nothing make sure you have a 49cc plate on the back so they dont get confused when they see TaoTao 50 when its really 49.4cc.

Lucky for me mine is titled at 49cc. This means I have a lot of rules to bend when I finally get around to installing a bbk. ;D
Why didn't your friend try to insure his vehicle? Sure you can get a cheap scooter for $400 on craigslist, but it's so cheap for the insurance... Such a terrible situation.

i tired to get insurance in va for scooter 49cc and they said it was only good for off road use and would not insure it for on road use

Ive heard that also teddy, I have mine insured through State farm. At 3.45$ a month its hard not to.

What if it says its a 49cc on top of the valve cover but it's really an 80cc.. ;D

There's no reason; and zero benefits, why a company would want to register a scooter as 50cc. 72, 75, 80cc perhaps; because it gives more acceleration and top end, while still having great gas mileage. But the 1cc difference does not make a difference at all.
TaoTao ATM50 is registered as a 49cc scooter, but in their manual they state that the scooter has a 50.6cc engine

My 50 is insured with Progressive I used to use Foremost . Say you want to insure your motorcycle not scooter or moped

If it truly was a cops word saying it was 50cc then all you'd have to do is prove to the judge that it's not 50cc. All 139qmb scooter engines are in reality about 49.6cc.
The police aren't allowed to arbitrarily judge your engine size, if it's a 49.6cc engine then it is under 50cc and if state law says 50cc max for no registration or insurance all you'd have to do is provide the judge the proof like a manufacturers spec sheet.
If that's true I would get a lawyer and have them sue the police department because they didn't provide due process before revoking his license.
As for medical bills and damages, well that's when you're on your own.

prodigit the 1cc difference is he DIDN'T have insurance cause it wasnt need on a 49cc and didnt have to have it but with the cop saying it was a 50cc he needed it but didnt have it same with the dl in a lot of state scooters 49cc and under dont need insurance or a dl but 50cc and above you need at the above Skuttdawg In va anytime i had to insure a car or motorcycle i had to have registration so im not sure if that will work for me but yall got the ball turning and i am going to try some more company's

But 49.6cc vs 50cc..oh come on they are splitting hairs just to make money. Also how does the Officer know it's 50 vs 49.6...did her measure the bore and stroke?.. Wow..it is getting nuts out there is it not?..
