Midwest Scooters: Mrs. Eckers i will warn you if you or your husband continue with these FALSE accusations we will be forced to counter suite you. See you in court along with the letters you and your husband have posted on here as a form of harassment. This is an attempt to collect a debt you have failed to pay ordered by Judge Spear. THAT IS FACT. You have failed to honor YOUR warranty. THAT IS FACT. Everything posted on your site, Scootdawg, and craigslist is fact. You stated in a phone call to me you are going to appeal Judge Spear's ruling, however I have failed to receive any info from you, your attorney,the courts or any rep. considering this matter. FACT. You stated your grounds for an appeal would be for the manufacturer to pay the order under the lemon law. FACT. You must understand in Indiana motorcycles are not protected under the lemon law and the scooter I purchased from you is classified as a motorcycle. FACT You where sued in court not under the "lemon law" but not honoring your warranty for repairs to a "Lemon" as Judge Spear stated.(reread original filing)Re watch and reread station 59 report. Not once did I mention Midwest Scooters name or endorse your company. FACT. So in closing your site is an open forum and everything stated is TRUTH AND FACT, and if you did file an appeal and have not followed up or requested a trial date I will under my rights file for a trial date, and only because I am a consumer standing up for my rights DOES NOT make me or my family poor Christians as you would like some people to believe.

I spoke to soon the other day when I wrote the follow-up regarding my suit against Midwest Scooters. The first paragraph is a statement that Midwest Scooters has posted on their facebook page in regards to obtaining payment from the civil suit I had won. If you go to their facebook page you will first notice the comment that I made and they responded to has been removed, and I have been blocked from placing anymore comments. The second paragraph is a word for word response I sent to their contact page on their web site.

If anyone who has read my postings regarding this situation and would like to make a comment on Midwest Scooters facebook page feel free to do so.

No doubt one thread is good you have what 4 or 5? We get it you got burned. A Chinese scoot without an actual warranty isn't actually news I think most on here know that. I wish well but updating an existing thread is probably sufficient...

Just a word of friendly advice to budster441.

I would be careful of constantly posting negative comments about Midwest Scooters on forums and Facebook. This "could" be viewed as harassment by a court and inviting others to comment on their page: "If anyone who has read my postings regarding this situation and would like to make a comment on Midwest Scooters facebook page feel free to do so." is not a good idea. If Midwest Scooters looses sales because of comments made by others, that has not done business with them, and it is attributed to your comment, then you could be held liable as a contributor in a lawsuit.

I am not saying that you may not have gotten a bad deal, nor am I saying that they did not honor what they said they would, I am just giving advice that you could have some legal issues that you do not want. In this day and age, people can sue for anything they want. Regardless if you win or not, you still have the court hassel and posible money out of your pocket for legal fees.

I dont remember what the whole story of this is , but i know all chinese scoots break mine broke a bunch and i've replaced almost every part but i expected this when i bought it. I don't advise anyone to buy a chinese scoot that doesn't have any mechanical knowledge the seller doesn't make the scoot it comes from china be prepared to work on it if you choose that route, its not a honda. You get what you pay for 700 800 bucks what do you expect its gonna break and you will need to repair or upgrade many parts in a short amount of time its how it works

Who in the hell is deleting entries? I posted something yesterday saying that If it was a Small Claims court making a judgement it really does not mean much. Small Claims Court do NOT enforce the judgements.

This forum is for people to come to and enjoy, seems that you only come here to post about a bad experience and try to make progress in your grievance.

You have apparently won in court and are having trouble collecting. I would suggest that the proper way to collect a debt is by getting wages attached and filing liens on that persons property. Very easily done, I did it once utilizing the services of a legal typing service, they did the forms up and registered it in court for a very reasonable fee. I got that persons wages garnished and put a lien on their house, made them mad but got me my money. You just need the judges ruling on paper.

Now it is time to put it to bed.
