I was making a routine run to the corner store about 2 miles away. I live in the country and the store is on the highway. On the way back. I hit my left signal to turn onto my street. There is a Nissan Titan behind me and my neighbor turning right off of my street. I check my mirrors before the turn and notice the truck behind me. He was a distance away and my turn signal had been on for a good distance (I always use my signals a little early). Mid turn I see a BIG GREY BUMPER out of the corner of my eye. Bars hit the headlight of the titan. My left had pushed me away from his passenger fender and I jumped shoving the bike into him. I flew for a minute and landed on the chin of my helmet. slid on elbows chest and knees for a few. Then got up took off my helmet and chased the c*&@$%!#er down. He got out of his truck and I was going to beat him. BADLY CUZ IM STILL ALIVE YOU IDIOT TWERP IN AN OVERSIZED TRUCK! Dude was trying to pass me on the left when i was taking a left. He didnt want to slow down for the scooter. Saw my neigbor pulling out. then decided to hit the guy on the scooter instead of the car. My neighbor is 89 years old. I'm glad he hit me. She saw me go down and stopped. Called the police. I told them I didn't need an ambulance. My other neighbor showed up with a nurse she patched me up. Police took statements. Guy in the truck didnt even have a licence. The jaw to my helmet looks like a joke. Scoot has a bent tripple tree, forks, the taillight is broken, the handlebars are bent, it wont start by button i have to kick it, the seat is wore off and the only plastic on it (the headlight and housing) is now broken. New triple, forks and plastic it will be good to go.
Isnt his insurance supposed to pay for this? I have never been in a accident before with a car. The cops just gave me a card and said to check online in a week.
WEAR YOUR DANG HELMETS PEOPLE!!!!! 3rd time this has saved my rear.

I am glad you are okie! I have been in accidents on my scooter before. as for the insurance if he has insurance then yes hopefully they will pay. usually you need to get an estimate done by a shop for cost of parts and repair. I am not sure tho who needs to contact his insurance company if its you are him. Good Luck and i am glad you are okie! Yes Helmets save lives!! I always wear mine

I wouldn't be paying for any repairs if someone hit my vehicle during an illegal maneuver. If he has no insurance you would have to take him to court. You need to make a claim for repairs and damages against his insurer if you have his insurance information on the report. typically insurance claims involving scooters that result from a collision will total out the scooter, but that is not an indication or claim by me that it's not repairable.

Can I do my own estimate? I'm not trying to rape the guy. I'm pretty sure I can fix it cheaper than a scoot shop and the local ones are VERY dishonest. I would prefer a new scoot than them touch my scoot. The only time I have is to get a carb jet set a week or so ago... they didn't believe my speed claims and asked to pull the head to see if it was a 63 or a 50 (I made them agree to give me a new scoot if they messed mine up). They said its a 63 but I've read all the threads about them and I cant find any identifiers. my oil cap/dipstick flew out on the way home. I think they made it losser. I have never had it fly out in 3446miles. I have a new one on order from scrappydog. Regardless, is this a possibility (my estimate vs, shop)? Yes he was an idiot driver, Yes he hit me without looking, Yes, I would LOVE to see him pay. No, I don't care. I just want my scooter to be driveable so i can get to work and see my girlfriend.

Glad your ok.Your going to need an estimate from a licensed repair shop, the insurance company is not going to accept one that you come up with and will send an appraiser of their own to look at the scooter as well before making any claim offers. do go see a doctor as well as accidents have a way of getting worse after a few days, you may have more medical problems down the road then you feel you have right now. if worst comes to worst consult an attorney.

Get on him today and don't let up! If he didn't have a drivers license I doubt he had insurance, but I'm sure he would rather buy you a new scooter for a grand rather than come up short in court. Do see an attorney, consultation should be free, and could save/make you thousands. Glad you're ok (but you may not really know for some time yet).

It will need to be an estimate form a Shop that works on the scooters. Show up to a name brand manufacturer shop and they'll probably tell the adjuster it's a total loss because they don't want to work on the thing. You are not bound to have the shop do the work for you and can have the check sent to you and you are free to have the repairs done by yourself or take it where ever. Some shops are dishonest, the most common things I've seen them do for quick cask is to cut drain tubes on the gear-oil drains of some scooters. The fluid all drains out and you can drive it for a good hundred or two miles with no clue something is wrong.

Glad you lived to tell the tale. Like others have said, get a check up.
As for the SOB, consult with a lawyer and try to get an aggreement with him, next, get the ride of your dream.
But please go see a doctor. Better safe then sorry.

Who got the TICKET?. When there is an accident someone gets a ticket for being at Fault. If the Driver of the Truck got a ticket and he has insurance his insurance will claim as totaled and write you a check for the blue book price of the scoot. Wile

You should have went to the ER anyways to be safe and his insurance will pay for it . The more medical bills you pile up the more your settlement will be . I would say the scooter is totaled and demand a new one

I think the guy went to jail. No licence. Im not sure though because the cop sent me home before she finished with him. He was trying to get out of it before he called the cops saying "what would it take for me to not go to jail" I said call the cops and an ambulance followed by your insurance. It's the cops call whether or not you go to jail. He then told the cops that I tried to extort him. I had a witness though that said no such thing happened. Yet another reason I don't like "BRO'S". The cops gave me a card with a accident report number on it and said it will take a week or so before i can look it up. I spoke with two attorneys I know. They both said I should go down to the police station and get that report now. And take really good pictures of my injuries and the scooter. Most likely it will be totalled out. I'm going to try to find an aprillia or vespa dealer to look at the scoot. If i cant find one its off to one of the big four japanese companies. I have to go out and get some insurance today so I can ride one of my other bikes for a few weeks. My girlfriend wants me to quit riding two wheels....not happenin;-)

Good luck Psych, But if didn't have a license I doubt he had insurance to tell you the truth. So you may wind up sueing him and usually that takes quite a bit of time to receive anything. The accident chaseing lawers will take the case and the way that works they take quite a bit of chunk of any settlement first and the rest goes to you. But keep you head up and for sure get insurance, you can find full coverage for usually under a $100.00 dollars a year. Wile

The reason there are people driving without insurance and being careless to boot is because they never suffer any consequences. Get every penny coming to you for your scooter (and a new helmet) and make sure your body is ok. I would almost see if you have a family friend who is an attorney and see if there is any way you can somehow leverage him getting his truck back for you getting your money. He is basically not going to pay you and does not have insurance, so you need leverage of some kind or you have to make your uninsured motorist coverage pay and he gets off scott free. I am not for screwing an honest person and an honest mistake, do not misunderstand, this guy sounds like the farthest from an honest person you can find.

I am glad you are ok and able to talk about it. Here in Florida we have no-fault. If he has no license he goes to jail. I don't think this guy has any money and will have to sue but he has nothing. So like Florida sue your OWN insurance company. Then they will go after him. As far as getting the scooter fixed don't bother get a new one, it will never be the same and besides you need to change your LUCK. Go to the hospital I am sure your back hurts, right and see a lawyer. Good luck and thank God you are ok after that

I thank you all for your advice. Yes I am very ok other than the road rash and my ankle hurt a bit yesterday. Today I'm almost normal. I took my Motorcycles out for a ride today to see which one I'm getting tagged tomarrow. I felt clumsy riding them. I've been on scooters for the last few months. Scooters are much more nimble, I oddly felt safer on my scooter than I did today riding my MC's espeacially the cx500 WAYY top heavy, I forgot it was and almost knocked it over in the garage. I settled on the KLR (as usual) not very fast but don't sqirm on gravel like the SV and weighs the same, although the SV kills them both in comfort. I rode the scooter today too. All the way to the store and back at 15mph...wayyyyyy on the shoulder, just about in the grass. I was scared just to be on the highway. I looked at it real good and hope they dont total it. I'd rather fix it. all I need is a triple tree, rim/rotor, and new taillight. the plastics that broke were getting replaced anyway with projector type headlights for a bit naked look like my SV or CX. If they total it than I have to turn my scoot in to the insurance company. My motor is rock solid and I would rather fix my scoot than deal with another motor. These scoots are a dime a dozen I know but good motors are a needle in a haystack. The day before I got hit I ordered a bunch of stuff from scrappydog, and a bunch of stainless mesh and aluminum tread plate for the new body. I would hate to have to re-purpose them.

Typically, if you want to buy back your totaled vehicle from the insurance company, they'll let you do it, but you'll have to get a salvage title for it instead of the original. As for wanting to get it back on the road... I'd be worried about the welds on the frame. If the triple tree is bent, then there is likely a weld cracked in the steerer that will take some time to reveal it's self--usually while speeding down the road. I don't mean this just about cheap Chinese scoots, either. Working in a bicycle shop, we would total any frame that came in after being hit by a car, even without visible damage. It's just not worth the risk of your frame breaking mid-ride, IMHO.

I'm glad to hear you came out mostly okay too! We gotta watch out for idiots that will do this, although it is usually too late by the time you realize what is happening. The same thing happened to me 3 years ago. I saw the jerk coming up fast behind me and I already had my left signal on, but as I started my turn, there he was on my left. Had no choice but to jerk right, then went back into the turn and my front tire hit a big pothole around the manhole cover in the street. I went down, put my left arm up to soften the blow as I hit the pavement. The bone in my arm snapped at the ball socket and I got a lot of road rash. As I lay in the street, I saw a little kid like 4-5 in the back window looking back as the not a very nice person was speeding away. No...the jerk never stopped. And this all happened like 3 houses from my own. So I drove my car with basically one hand, 5 speed stick, to the hospital. That was my worst encounter so far.

Well 2 weeks later.. I call the Michigan State Police. again. The officer had not finished my report yet! Then she tells me that I have to drive to Hart, MI 63 miles from my house, to pick up my report or wait another 10 buisness days before it shows up in the online system. Both my lawyer friends told me they doubt he is covered on his girfriends insurance and they are pretty sure that it wouldnt cover an unlicenced driver anyway, and i am most likely going to have to sue the pants off him. They are both willing to represent me for free if everything goes south.(gotta love having good friends).

Geez! Glad you are okay for sure! Having just joined the scooter culture recently, it has become glaringly apparent how reckless and careless the seeming majority of motorists are when it comes to giving right of way, ample following distance and just general etiquette to the scooterist. I have had some un-nerving close encounters myself in the short month and a half that I have been scootin'! It come's down to this.. (for me anyway) Drive defensively and be as close to 100% aware of traffic in all directions. Plan ahead if you can, to bale if you have to. I know city scootin' can be more un predictable than suburban, but an ounce of prevention....
I agree, I would file a lawsuit.

I had a friend, in Florida, who was turning left in a trailer park, with his signal on, and when he started to turn, the truck behind him tried to pass and hit him. He got the ticket, not the truck for failure to yield right of way on a left-hand turn. That ain't right, I don't care who you are.

Wow no fault is a load of BS. They never declared who was at fault because the officer never mentioned that when she picked up my bike that the turn signal was indeed still on, When she was questioned about it she did not recall the signals being on. Dude who hit me did not have a lic, and got away with nothing (he already went to jail for it) because I didn't get in an ambulance. I got left with zilch but a somewhat still broken scoot, broken helmet, and scars from the pavement. At least I had free representation. If I had not already fixed my scoot I would be very @#$%^ angry right now... Why doesn't Michigan run insurance like any other sane state? This no fault shift is BS.
