Ya, seen a football player hit the identicle sameway. Pretty scary. I think cars care about getting involved in a accident, but the drivers think the scooter is moving slower than it really is or another thing, cars look for cars and not motorcycles and scooters. I ride on country highways and enjoy that much more than city riding. Much more can happen at city intersections. I am glad you are o.k..

Very difficult to post this, but now I wrecked my Vino. I rode it all winter, just like I did the previous winter with the Motobravo, but on a (relatively) warm, sunny day, the off-ramp was wet, but what I didn't know was that in the shade under the bridge, the wet pavement was actually frozen. Had I been thinking straight, I would have realized that even on a sunny day, when the temp is 35 degrees, the ground temp can be much colder, and I should have been wary of ice, which I can handle easily, as long as I know it's there. Rule #1 for riding on snow or ice: Know when you're riding on snow or ice.
The damage to the Vino was mostly to the plastics, which IMO are fairly cheap compared to car body panels. The short version of the story is that I broke my right arm (non-displaced fracture of the radial head, which is about the best kinda fracture if you're gonna have one) It's running again, just as smooth and stable as the Vino 125 always is, and today I just duct-taped the plastics back together. A friend of mine has a bunch of fiberglass tape and resin, so we're gonna fiberglass the plastics back together, and in my day job in special ed at a charter high school for at-risk youth (think gangs and bad neighborhoods), I asked one of our graduates who is in an art program in college if he would be interested in a commission to do up my Vino in a design that would highlight the ugliness of the wreck - a sorta Mad Max look.
As for the accident that started this thread, I STILL haven't heard from my attorney, despite calls & emails. Not sure how to proceed.
That's my update. And BTW, my physical therapist last summer was not only awesome, but she was SO beautiful! Ciao fer now!

Just wanted to mention my perspective as a former car driver that what makes it difficult to judge a bike's distance and speed for me is the fact that there's only one headlight, not two widely spaced headlights that go farther and farther apart, depending on the speed and closeness of the car. Like I said last year, I feel sorry for the cage driver. He had a (MN Class A) CDL, and I think he was a trucker picking his kid up from school in their family car, and I'm sure his wife just let him have it on their ride home! (She was so nice to me, but she just barked at him in whatever their native language is.) And I don't know what the consequences are of having a CDL and being a trucker when you get cited for inattentive driving, causing an accident with injuries. His wife was livid, he was terrified, I was in pain, but pain beats that kinda fear any day! A Somali immigrant too - I imagine coming from a hell-hole like that, the hard work he had to put into learning a new language, getting educated, going to school for a CDL, and finally getting a decent trucking job, making enough money to put his kid in an African-centered private school, and then making a stupid-ass mistake like that. I wonder often how things turned out for him... He could have lost everything!

Just to chime in some .02. I was in a bad car accident, in 2006, that totaled both cars and took a year of my life away. Both of us walked away from the accident - but I had some damage to my knee (which means I can look forward to a Steve Austin knee in about 15 years). Just like you I also suffered (still do) from headaches since the accident (although I went through the whole MRI and brain scan stuff to determine that their was no permanent damage. And, also like you, I hit the depression wall (which is why I say it took a year of my life) over the prospect that I could no longer perform the job I loved (Video camera operator in 'hostile' environments) as well as I could and the fact that I would DEFINITELY need a knee replacement sometime in my life.
The cage replacement took 3 weeks from the date of the accident - the "pain and suffering" took 1 year from date of accident. And, unlike in your case, the other party 'amended' their original statement to the police (from the scene) to say that I had caused the crash.
Although every state is different in how their legal wranglings are - here's hoping your comes to a conclusion soon.

I'm not a typer but I will breifly say i broke my ankle in a crash april 2nd 2011 my shoulder was immovable had contusions and road rash on hands jacket took all abrasions exept my hip(didn't put on gloves that day) jambed rigght Thumb right big toe left shoulder chin road rash somehow fullface helmet scratch a little worst that yours busted plastics on drivers side prior too the accident a rock busted my windsheild i was fine with that was thinking i'd clear ducttape it then a dirtbike i was following (illegal no mirrors on it no signals) I thought it was turning right in a corner cause its brake light looked like a signal and i hit little much front brake in gravel on the turn front tire skidded out (This part i dont remember post truamatic...) somehow broke right ankle smashed left of scoot denied amberlamps(hehe) walked away didnt want scooot stole waited 6 days hopping on it sayind its just a sprain well went to the hspitol in pain and xrays revealed i needed surgery im still on crutches cant walk! 5/23/2011
