What can i do first to modify a 49cc TAOTAO..new...400 miles..... to run a reliable 40-45mph.....

If it has a revv limited cdi buy one with no revv limiter, check for a restricting washer in the variator, you may or may not have one, performance pipe, performance air filter, but anytime you change the amount of air entering or exiting the engine you have to put a bigger jet in your carburetor.

Unless you are on flat ground with a tail wind, a true 49cc Taotao is not going to run the speeds you want consistently. It would have been better to spent a few dollars more up front and get a VIP / Peace / whatevername, that has a 60cc engine to start with.
Otherwise, plan on a 72cc upgrade.

Can a 4 stroke 49cc tao tao handle the 72cc BBK? if so what other things in the scooter will you need to upgrade to keep up with the BBK? ( Only if your just upgrading the engine nothing more)

You should check the exhaust pipe for restrictors, if there is none, then the exhaust is OK. The carb will probably be OK. Do a plug check after a run in to see how it looks to see if you need to rejet. The only thing you may have to do is move to slightly heavier rollers since the new kit will have more power, and you could be over-revving.
Don't mess with the air box. You need to get each thing dialed in before throwing a lot of things all at once. This way you know what is working and what is not.

The 2011 Tao Tao scooters do come with a stock 44mm(63cc) bore. From what I understand the newer Peace bikes are true 50cc. We stopped carrying Peace last year because of that.

What's interesting is that my 2011 Peace Sports 805's are FASTER than my 2009 Peace Sports which has a 63 in it.

What I've noticed is the 49cc ones came with a black top carb and the 63cc ones come with a gold top carb.

That's definitely coincidence. The cap on the carb is just whatever is handy.
The most probable indicator is the on the engine stamp. The trend has been to use 139QMB to mean 50cc and 1P39QMB to be 63cc. This is not a given; by Chinese standard the "P" means "Horizontal" and is thus redundant. People have discovered a 39 mm bore in their "P" engine and a 44 mm in their regular marked (true secret 60), but it has seemed mentioned more often than not in recent times that the "P" engines have the 44 mm bores. These secret 60's also often have performance heads with taller than standard valves and equally shortened rockers, something to be aware of if upgrading the top end.

We just sold several Taotao scooters, all recent import 2011s that were 49cc. I would like to get my hands on some of the 60cc. But, the 50cc Taotao has definitely helped sell the higher profit VIP. Once a prospective customer rides both, they find the extra money for a VIP rather quick.
Plus, the difference in legnth, gauge upgrade, rear foot pegs, and high speed stability, make the VIP a much better scooter, even when both have the same engine.

you take off the rev limiter you mine as well trash the bike. yes you will get some insane speeds but you will also be shopping for a new engion very soon. cant tell you how many kids around hear blew up there little 50cc jobs doing that.

We have only been selling the ATM-50A1 (Speedy) All of the 2011s we've had are 63s. Not sure about the other models. The carbs have different jets in them the 49cc ones with the black top carbs had 72 main and the 63cc ones with the gold top carbs have a 78 main. They are running too lean with the 78 so i have been putting 85s in them. Both the 49cc AND 63cc ones have 1P39QMB on the motors.
